OFFER FOR VOLUNTARY ACCIDENT INSURANCE CONTRACTS FOR RAILWAY PASSENGERS WHEN EXECUTING AN INSURANCE POLICY VIA THE INSURANCE AGENT'S WEB PORTAL

This offer (hereinafter referred to as the “Offer”) is an offer addressed to an unspecified circle of individuals by Rosgosstrakh Insurance Company Public Joint Stock Company (hereinafter — "Insurer") to conclude a contract of voluntary insurance of railway transport passengers against accidents for the period of travel in accordance with the formed electronic travel document (hereinafter — "e-ticket") (hereinafter referred to as the "Insurance Contract (Insurance Policy)"), taking into account the conditions established by Passenger Insurance Rules No. 215 as amended on August 23, 2019 (hereinafter — "Insurer's Insurance Rules").

This type of insurance is voluntary and it is your right to sign an Insurance Contract (Insurance Policy) and pay the insurance premium. The conclusion of an Insurance Contract (Insurance Policy) is not a prerequisite for purchasing an e-ticket.

Licence issued by the Central Bank of the Russian Federation (Bank of Russia) Series SL No. 0001 dated June 06, 2018. (the Licence validity period is not limited).

In accordance with Article 438 of the Civil Code of the Russian Federation, the unconditional acceptance of the terms and conditions of this Offer by an individual is considered to be a positive marking "☑" on the page opposite the statement "I confirm that I have reviewed the rules and specifics of the order placement, its payment, forming of travel document (ticket) and its forming anew, return of unused travel document (ticket) ordered via Internet. I also confirm that I have read the Rules of the Insurance Policy and the Offer on the web portal of JSCo RZD (https://eng.rzd.ru/), as well as rules of payment of insurance premium in accordance with the terms of the Insurance Contract (Insurance Policy). Performance of these actions means the individual's acceptance of all the terms and conditions of this Offer, the terms and conditions of the Insurance Contract (Insurance Policy) and the Insurer's Insurance Rules and constitutes the conclusion of the Insurance Contract (Insurance Policy) in writing.

As a user of JSCo RZD web portal and a potential policyholder, you confirm your right and capacity, financial solvency, as well as understand your liability for obligations assumed by you a result of the acceptance of this Offer.

Application for insurance is considered as entering on the web portal of JSCo RZD of personal data of persons subject to insurance under the Insurance Contract (Insurance Policy) and a positive mark "☑" opposite the statement "I confirm that I have reviewed the rules and specifics of the order, its payment, forming of travel document (ticket) and its forming anew, return of the unused travel document (ticket) ordered via the Internet. I also confirm that I have read the Insurance Rules for the executed insurance policy and the terms and conditions of the Offer", by which the potential policyholder expresses his/her consent and the consent of the insured persons (previously received from the Insured Persons):

  • with the Offer terms and conditions;
  • with the Insurer's insurance rules;
  • for the processing of personal data specified by him/her when forming an electronic ticket, by the Insurer and the Insurer representative — Joint Stock Company Federal Passenger Company, including collection, systematization, accumulation, storage, refinement, use, depersonalization, blocking, destruction (without notice of destruction), by automated or non-automated processing in order to carry out insurance activities for a period of 5 years, as well as their transfer in order to fulfill the Insurance Contract (Insurance Policy), and to ensure internal document flow, to third parties.

Consent may be withdrawn (in whole or in part) by submitting a written application in any form by the Policyholder (Insured Person) to the Insurer at 7, Kievskaya Street, GSP-1, Moscow 59, 119991, Russian Federation. The Insurer undertakes to ensure that the personal data of the Policyholder and other individuals specified in the Insurance Contract are secured and not disclosed in accordance with the requirements of Federal Law No. 152-FZ dated July 27, 2006 "On Personal Data".

OFFER TERMS AND CONDITIONS

1. BASIC CONDITIONS

The Insurer is Public Joint Stock Company Rosgosstrakh Insurance Company (hereinafter referred to as "Rosgosstrakh"), carries out insurance activities in accordance with the legislation Russian Federation and License SL No. 0001 issued by the Central Bank of the Russian Federation (Bank of Russia) dated June 06, 2018 (License validity is not limited).

The Policyholder is a legally capable individual who has concluded an Insurance Contract with the Insurer for the formed electronic travel document (ticket) in relation to themselves or third parties (Insured Persons).

The Policyholder who has concluded the Insurance Contract (Insurance Policy) on the insurance of its property interests is the Insured Person.

Insured Person is an individual specified in the Insurance Policy making a trip on rail transport as a passenger in accordance with the electronic travel document (ticket), for whose life and health the insurance contract has been concluded.

Insurance Contract (Insurance Policy) is a document confirming the conclusion of a contract between the Insurer and the Insurer of voluntary insurance against accidents of railway passenger transport for the period of travel in railway transport according to the formed electronic ticket in the manner provided for by this Offer and the Insurer's Insurance Rules.

The parties to the Insurance Contract (Insurance Policy) are the Policyholder and the Insurer who have concluded the Insurance Contract (Insurance Policy).

1.1. The Beneficiary is the Insured Person in respect of whom the Insurance Contract (Insurance Policy) has been concluded and who is entitled to the Insurance Benefits, except for minors, in respect of whom the Beneficiaries are the legal representatives of minors - their parents or guardians.

In the event of the death of the Insured Person, the heirs of the Policyholder (Insured Person) are recognised as the beneficiary of the insurance benefit.

1.2. In the event of the death of a minor Insured Person, the legal heirs of the minor Insured Person are recognised as the Beneficiaries. In order to receive the insurance benefit for an insured event involving a minor, the Beneficiaries must additionally submit to the Insurer a Birth Certificate of the minor confirming their parental rights or a Guardianship Certificate confirming the rights of the minor's guardian. An insured risk is an anticipated event that has the characteristics of probability and randomness, against which insurance is made. The occurrence of an event described as an insured risk is an insured event.

1.3. An insured event is an event specified in the insurance contract, upon the occurrence of which the Insurer's obligation to pay the insurance benefit to the Insured Person (Beneficiary) arises.

1.4. The Insurer's Insurance Rules are available for inspection on the Insurer's website by clicking the link.

1.5. The insurance amount under the Insurance Contract (Insurance Policy) is one million five hundred thousand rubles (1,500,000) for each Insured Person when paying the insurance premium of one hundred and fifty (150) rubles.

1.6. Other terms of the Insurance Contract (Insurance Policy) are defined by the Insurer's Insurance Rules which are part of this Offer.

1.7. The Insurer representative — JSC FPC undertakes, at the written request of the Policyholder (Insured Person), drawn up in any form and sent to the address: Moscow, 34 Masha Poryvaeva St. to provide information defined in Clause 5 of Article 8 of Law No. 4015 of the Russian Federation dated November 27, 1992 1 “On the organization of insurance business in the Russian Federation“.

2. CONCLUSION, ENTRY INTO FORCE, TERMINATION AND PAYMENT FOR THE INSURANCE CONTRACT (INSURANCE POLICY)

2.1. Procedure for conclusion and entry into force of the Insurance Contract (Insurance Policy).

2.1.1. The positive mark “☑” in the field “Registration of an Insurance Policy” on the web portal ofJSCo RZD is equated to the Application for the registration of the Insurance Contract (Insurance Policy).

2.1.2. The Insurance Contract (Insurance Policy) is formed on the basis of the data presented by the Policyholder on the web portal of JSCo RZD and is available in the Personal Account of the Policyholder on the web portal of JSCo RZD.

2.1.3. The parties to the Insurance Contract (Insurance Policy) agree that the receipt by the Insurer or its representative (including JSC FPK) of the insurance premium under the concluded Insurance Contract (Insurance Policy) - on the one part, and the signing of the Insurance Contract (Insurance Policy) by the Insurer using a facsimile of the signature of the Insurer's authorised representative and the Insurer's seal - on the other part, is a proper signing of the Insurance Contract (Insurance Policy).

The Insurer and the Policyholder undertake to reproduce the Insurance Contract (Insurance Policy) on paper if necessary.

2.1.4. The parties confirm their agreement that the transfer of the Insurance Policy to the Personal Account of the Policyholder on the web portal of JSCo RZD is a proper delivery of the Insurance Contract (Insurance Policy) to the Insurer. The insurance premium payment by the Policyholder in accordance with the terms of the concluded Insurance Contract (Insurance Policy) is also a confirmation of the Policyholder's consent to receive the Insurance Contract (Insurance Policy) in the specified order and consent to the terms of the Insurance Contract (Insurance Policy) and this Offer.

At the written request of the Policyholder (Insured Person), not later than 30 business days from the date of the written claim receipt, the Insurer transfers the Insurance Contract (Insurance Policy), signed by the original signature of the authorized representative of the Insurer, and appendices thereto, at the location of the Insurer, at the address specified in Clause 3 of this Offer.

In the same order, the Insurer may be provided with a duplicate of the lost Insurance Policy signed by the original signature of the representative of the Insurer.

2.1.5. The Policyholder who has declared the conclusion of the Insurance Contract (Insurance Policy) acts on behalf of all declared Insured Persons, therefore, all Insured Persons and the Beneficiaries are considered to be informed about the terms of the Insurance Contract (Insurance Policy), the Insurer's Insurance Rules and the terms of this Offer.

2.1.6. The Insurance Contract (Insurance Policy) is considered to be concluded from the date of payment by the Insurer of the insurance premium in the established amount and is valid for the period specified by the Insurer's Insurance Rules. Insurance protection under the Insurance Contract (Insurance Policy) is valid in the manner and for the period determined by the Insurer's Insurance Rules.

2.2. Procedure for payment of insurance contracts (insurance policies).

2.2.1. Payment of insurance contracts (insurance policies) is carried out in a non-cash form in accordance with Article 3 of Federal Law No. 161-FZ dated June 27, 2011 “On the national payment system” (rev. December 29, 2014) with the help of Visa, Visa Electron, MasterCard, MIR, Maestro, international payment systems Visa International, MasterCard International. Payment by bank card is made after checking and confirming the order with forwarding to the payment gateway of VTB Bank (PJSC). The Policyholder shall be given 10 minutes to make a decision on payment of the order and enter the details of the bank card. In case of exceeding the specified time, the Insurance Policy is cancelled.

When paying for the order, the following details of the bank card are entered: name and surname of the card holder, its number and expiration date, as well as the three-digit code (CVV2 or CVC2). For explanations about the peculiarities of payment with a bank card of the Policyholder on the Internet, reasons for refusal to pay, the Policyholder shall first contact the support service of the Policyholder bank.

Security of the payment procedure is ensured by the use of traffic encryption tools (SSL).

Specifics of payment with Visa Electron and Maestro cards:

Dear Insurers, make sure that your card has the CVV2 code (CVC2) placed on the back of the bank card. Attention to the cardholders of foreign issuers! In accordance with the requirements of international payment systems, 3D Secure/Secure Code (a special Internet payment security technology) is used to improve payment security. If your bank is not certified to use this technology, you may be refused to effect payment by the payment system. If you receive a refusal to pay, please contact the support service of your bank.

In accordance with the requirements of 3D Secure/Secure Code technology, when paying for an order, the issuing bank may require the cardholder to undergo additional identification. The need for additional identification and its method is determined only by the issuing bank. For more information on the identification procedure, the cardholder should contact the support service of the card issuing bank.

If for any reason you have not received an order number or the Insurance Contract (insurance policy) or confirmation of successful order formation, please go to "My Orders" before placing a repeat order and check that the order has indeed not been formed.

2.3. Early termination of the Insurance Contract (Insurance Policy) on the Policyholder initiative. Return of the insurance premium.

2.3.1. The Insurance Contract (Insurance Policy) may be terminated early on the initiative of the Policyholder within 14 business days from the date of its conclusion, together with refusal or without refusal from an electronic ticket. In case of refusal of the Policyholder from an electronic ticket formed using the web portal of JSCo RZD prior to the commencement of the trip in accordance with the above specified time periods (return of electronic ticket), the Insurance Contract (Insurance Policy) is subject to termination with the return of the insurance premium in the amount of 100%, due to the fact that after its entry into force, the possibility of occurrence of an insured event has disappeared and the existence of the insurance risk has ceased due to circumstances other than the insured event. In this case, additional documents are not executed by the parties, the basis for termination of the Insurance Contract (Insurance Policy) is the fact of termination of the carriage contract. Return of the insurance premium upon termination of the Insurance Contract (Insurance Policy) with the refusal of an electronic ticket using the web portal of JSCo RZD is made to the bank card account, from which the insurance premium was paid.

The insurance premium to be returned for an earlier terminated Insurance contract (insurance policy) shall be credited in full to the bank card account from which payment for the Insurance contract (insurance policy) was made within the term stipulated in the payment system rules (from 7 to 30 calendar days after drawing up the return in your personal account). Crediting the funds to be returned to the bank card account from which the payment of both the electronic ticket and the Insurance Contract (Insurance Policy) was made is carried out by separate payments.

2.3.2. Termination of the Insurance Contract (Insurance Policy) upon return of an electronic ticket carried out at the ticket offices of JSC FPC and also without refusal of transportation may be carried out only in Insurer offices at a written application of the Policyholder (Insured Person). Cases and procedure for return of insurance premium in this case are determined by the Insurer's Insurance Rules
