Public Offer: FOOD DELIVERY TO THE TRAIN

When registering a ticket on the website https://eng.rzd.ruyou can purchase and pay for the purchase and delivery of food (meals and drinks) to your wagon on the long-distance passenger train from catering establishments located in cities along the train's route.

By making a purchase on the website and in the app, you fully agree to the following terms.

JSC FPС shall not be responsible for:

  • incorrect data specified by the User when placing the Order, namely e-mail address, mobile phone number, as well as other data specified in the User profile;
  • settings of the mail client on the part of the User;
  • service settings of mobile and Internet operators providing e-mail and mobile services.

Terms and Definitions

Service is an access to the Restaurant Food Delivery Service for search, registration, payment for food (food and beverages) and its delivery to the long distance train wagon, in which the User is travelling, from the catering organizations located in the cities along the train route.

Company/JSC FPС is Federal Passenger Company Joint Stock Company, which is the owner of the software and offers the User access to the Service.

User is a passenger of a long-distance train, making or placing an Order using the Service on the terms of this Offer.

Supplier is a legal entity or individual entrepreneur providing services for preparation, packaging and delivery of food (food and beverages) ordered by the user.

Order is a set of food (food and drinks) formed by the User on the website https://eng.rzd.ru/, taking into account the food Suppliers available in the information database.

Order is procedure of selection of food (food and beverages) specified by the Suppliers on the website https://eng.rzd.ru/, forming the Order delivery to train, as well as subsequent payment by the User of the full cost of food (food and beverages) and delivery listed in the Order.

Restaurant Food Delivery Service/Service is a complex of software and technical means intended for search and Order placement on the website https://eng.rzd.ru/ . Opportunities and options for the Service use may differ depending on the train route, its location on the route and other circumstances that may affect the Service functionality for a specific User.

Delivery is a delivery of the Order by courier/Supplier representative to the User to the train wagon specified when placing the Order.

1. General provisions

1.1. By using the Service, the User shall accept the terms and conditions of JSCo RZD Policy on Processing and Protection of Personal Data (hereinafter referred to as the "Policy") and agree to the processing and transfer of personal data to the Supplier for the purposes of the Service use and for the purposes specified in the Policy.

The Contract on the Order Preparation and Delivery (hereinafter referred to as the "Contract") shall be concluded directly between the User and the Supplier. The moment of the Contract conclusion shall be the moment when the User pays for the Order. All rights and obligations under the Contract shall be vested in the Supplier.

JSC FPС may block the User possibility of placing an Order in case of default of payment obligations under the Order, violation of the Policy, and repeated breach of the Contract.

1.2. By placing an order, the User shall confirm his/her legal capacity, financial solvency and understand the responsibility for the obligations incumbent upon him/her as a result of accepting the terms and conditions of this Offer.

1.3. In case the User does not accept the terms and conditions of this Offer, he/she shall not be permitted to make and pay for the Order.

1.4. Offers and Policies may be modified unilaterally by JSC FPС without notifying the User. The new version of the Offer shall come into force from the moment of its publication on the website page https://eng.rzd.ru/ in Offers Section.

1.5. The number of catering companies available to the User for placing an Order shall depend on the region of the Russian Federation, the train route, the Supplier's Delivery zone, the availability of specific food (food and beverages), mode of the Supplier operation and other circumstances that may affect the Service functionality.

1.6. Information about the menu, availability of specific food (food and beverages), their composition, and delivery shall be provided by the Supplier.

1.7. After placing an Order, a receipt for fees, as well as a cash receipt shall be sent to the e-mail address of the User specified by him/her when placing the Order.

1.8. JSC FPС shall provide the following opportunities to the User as a part of rendering the Service under the terms and conditions of this offer:

  • choice of stations along the train route,
  • Information about the time of food (food and beverages) delivery to the train on its route;
  • opportunity to review the cost of food (food and beverages) and the conditions of their delivery;
  • possibility of placing an Order of food (food and beverages) from the range offered by the Supplier;
  • possibility to return the previously formed Order in accordance with Clause 2.4.3, 2.4.3.1 of the Offer.

2. Rights and obligations

2.1. JSC FPС shall:

2.1.1. Provide the User with remote access to information and technological resources of the Service (stations along the train route, dates and time of Delivery of the placed orders to the train wagon).

2.2. JSC FPС may:

Make changes to the Order placement procedure.

2.2.1. Perform verification of the User's data specified (provided) by them in the Service.

2.2.2. Refuse the User to use the Service without notifying the User and/or without explaining the reasons.

2.2.3. Establish additional conditions for the User's Order.

2.2.4. JSC FPС rights shall not be limited to the rights set forth in this Section and may be contained in other sections of the Offer.

2.3. The User shall:

2.3.1. When placing an Order, specify reliable information, be present at the place of the Order Delivery and ensure its acceptance. After a 10-minute waiting period following the train arrival at the station, the User shall be deemed to have withdrawn from the Contract and the money paid for the Order shall be used to reimburse the Supplier's costs and shall not be returned to the User.

2.3.2. Complete the registration procedure on the website https://eng.rzd.ru/by filling out the registration form, specifying his/her personal data (surname, name), other necessary data, or, if a valid electronic ticket is available, carry out the identification of the passenger in Ticket Service Registration Section (surname, name, ticket number and place in the train wagon). The User shall be responsible for the security of such data, as well as for all actions carried out on the website https://eng.rzd.ru/under his/her login and password.

2.3.3. Ensure the completeness and reliability of the information specified in the Order payment form.

2.3.4. Pay for the Order and Delivery of food (food and beverages).

2.3.5. Use the Service solely for the purpose of the Order placement.

2.3.6. Independently before the Order Placement through the Service, review the rules (conditions) set forth in Section 3 of this Offer.

2.3.7. When placing an order, specify in the comment to the order the information about the presence of allergies to certain foods. In case the User does not indicate such information, the responsibility for adverse consequences arising from an allergic reaction to the delivered food, including causing harm to life and health of the User, shall be borne by the User.

2.3.8. Comply with the terms (conditions) of this Offer.

2.4. The User may

2.4.1. Place an order to be delivered to the train wagon at the stations along the User route upon technical and technological capability.

2.4.2. Make orders in unlimited quantities. The User may place orders only from the Suppliers through the Service and for those types of food (food and beverages) that are available through the Service.

2.4.3. Make order(s) return on the website https://eng.rzd.ru/, in the User's personal account and in the Ticket Additional Services Section.

2.4.3.1. The money shall be returned in full, without levying additional charges, when the Order is returned in advance. The time provided for the return of money in full shall be set by the owner of the service (JSC FPС) individually for each station, taking into account the opinion of the Suppliers operating at the station, and shall be indicated in the User's personal account in Ticket Additional Services Section.

2.4.3.2. If the Order is returned after the time specified in Clause 2.4.3.1, the money shall not be returned to the User and the cost of the Order shall be charged to reimburse the costs of the Order preparation.

2.4.4. All enquiries about the Service operation, the procedure for making Orders, as well as their cancellation shall be sent to JSC FPС to the e-mail address: delo@fpc.ru.

2.4.5. Send in writing his/her proposals on the Service functionality and improving its work to JSC FPС to the e-mail address delo@fpc.ru.

3. ORDER DELIVERY TERMS AND RETURN OF MONEY

3.1. Upon the train arrival at the Order delivery station and opening by the conductor of the User's passenger wagon door. The User shall immediately enter the platform to wait for the courier/Supplier representative.

3.2. To receive the Order, the User shall wait for the courier/ Supplier representative at the platform of the Order Delivery station, opposite the door of the train wagon where the User travels opened by the conductor according to the travel document for which the Order was placed. If one conductor serves two wagons, the User shall expect the Order Delivery at the door of the wagon through which it he/she bordered the train.

3.3. If the delivery is carried out at the initial station of the train route, the User shall be required in advance, but not later than 25 minutes before the train departure according to schedule, arrive to the train for boarding. 20 minutes before the departure of the train from the starting station the User shall prepare to wait for a courier in accordance with Clause 3.3. of this Offer.

3.4. The formed Order shall be transferred only at the platform of the station chosen by the Service User at order placement.

3.5. At the time of the Order acceptance and transfer, the User shall review the completed Order for conformity of the delivered food (food and beverages), as well as the order form and, to prevent the Order transfer to other persons, have any form of travel document that may be required to identify the User.

3.6. In case of absence of comments to the delivered Order, the User shall sign two (2) copies of the order form, or make a mark on the Order form about the inability to accept the Order in full if there are reasoned comments to the delivered Order describing the reasons for which the User refuses to accept and transfer the Order.

Two (2) copies of the order form signed by the User shall be a confirmation of the fact of the proper preparation and delivery of the Order.

3.7. In case of delay of the Supplier's courier, the User shall wait for a courier at the door with the number of the User's wagon on the train.

3.8. In the event that the courier is late and the train is about to leave the Order delivery station, the User shall follow the instructions of the conductors of the passenger wagons and return to the wagon.

3.9. The User shall be prohibited to carry out any actions aimed at delaying the train departure from the Order delivery station.

3.10. Waiting time by the Supplier's courier for the User's train at the Order delivery station shall be 20 minutes. After this time, the courier may leave the delivery address without handing the Order to the User.

3.11. In case the Order was not delivered due to the fault of the courier/Supplier representative, or in connection with the violation of the train schedule, the User may within 7 days from the Order Delivery time provide information to the e-mail address delo@fpc.ru about the fact that the Order was not delivered. In the application, it is necessary to state the circumstances known to the User that caused the failure to provide the Order, as well as the User name, train number, User route, wagon number, station where the Order had to be handed over, the number of the travel document under which the Order was placed. The application shall be accompanied by a receipt for fees as well as a cashier's check sent to the User to the e-mail address specified when placing the Order.

If it is confirmed that the User complied with the terms of this Offer and the failure to submit the Order to the User had occurred through the Supplier fault, or due to a train schedule failure, as well as in the case of other reasons independent of the User's actions, the funds shall be returned.

In case of finding the facts of violation by the User of the terms of this offer, the funds shall not be returned to the User.

3.12. The return for the previously paid Order shall be made to the card by which the Order was paid, in accordance with the rules of the Russian and international payment systems and the legislation of the Russian Federation within 30 days after the date of the return registration.

3.13. In the event of the User absence at the platform of the Order delivery station in accordance with Clauses 3.2—3.4 hereof, the User absence on the train, as well as the User unwillingness to accept from the courier the Order previously placed through the Service, the courier shall make a note about the reasons for the Passenger's failure to accept the order on the order form.

Due to the User's failure to fulfil its obligations to receive the Order, the Supplier shall not return the money to the User for the losses incurred that have to be reimbursed in accordance with Article 393 of the Civil Code of the Russian Federation.

4. Personal data

4.1. List of actions with the User's personal data shall be as follows: collection, recording, systematization, accumulation, storage, clarification (update, change), use, transfer (provision, access), depersonalization, blocking, deletion, destruction, as well as any other actions with personal data in accordance with the legislation of the Russian Federation, including the transfer of personal data to third parties and other use for the purposes of:

  • User identification;
  • providing the Service User with the opportunity to search and pay for the order of food (food and beverages) and the Delivery thereof;
  • communication with the User, including sending notifications, requests and information concerning the Service use, provision of services, as well as processing requests and enquiries from the User.

4.2. JSC FPС shall collect and store only personal data that are necessary to provide all the Service capabilities.

4.3. Terms and conditions of processing the User personal data and their transfer to third parties.

4.3.1. With respect to the User's personal data, their confidentiality shall be ensured, except for cases of voluntary provision by the User of his/her information for general access to an unlimited number of persons.

4.3.2. JSC FPС may transfer the User's personal data to third parties in the following cases:

  • transfer is necessary as a part of the User's use of the Service for Order placement;
  • transfer is necessary as a part of contractual relations between JSC FPС and third parties;
  • transfer is provided by Russian or other applicable law as a part of the procedure established by law.

4.3.3. The list of third parties that receive the personal data of the User shall be as follows:

  • Carrier in which train wagon, according to the formed ticket, the User is transported and to which wagons the User has arranged the Order delivery;
  • Suppliers of food (food and beverages) with which JSC FPС has concluded a contract for delivery of food (food and beverages) to a long-distance train wagon where the User travels.

4.4. JSC FPС shall take the necessary and sufficient organizational and technical measures to protect the
User's personal data from unlawful or accidental access, destruction, changes, blocking, copying, distributing, as well as other illegal actions of third parties in accordance with Federal Law No. 152-FZ dated July 27, 2006 “On personal data" (hereinafter referred to as FZ No. 152).

4.5. By agreeing to the terms and conditions of this offer, the User shall give to JSC FPС consent to the processing of his/her personal data (Appendix No. 1 hereto) for the purpose of fulfilling Federal Law No. 152 and for the purposes, provided for in Clause 4.1 hereof. If, when placing an order under the terms hereof, the User shall provide JSC FPС with personal data of third parties and guarantee the legality of their receipt and the consent of the subjects of such personal data to their provision, and assume responsibility for the legality and validity of the said data.

4.6. By agreeing to the terms of this Offer, the User shall give JSC FPС consent to cross-border transfer of their personal data to foreign countries, as well as to countries that do not provide personal data protection in accordance with the legislation of the Russian Federation

4.7. Personal data obtained using the Service may not be used for advertising and information mailing.

5. Responsibility

5.1. The User shall be solely responsible for the reliability of the information provided by him in payment forms and Order placement forms in the Service and for all the consequences caused by unreliability of the information provided at the Order placement.

5.2. All actions of the User with the Service shall be performed by the User independently without the participation of JSC FPС. The User shall be responsible for the actual possibility of timely performance of actions at Order placement and receipt.

5.3. JSC FPС shall not be responsible for any damage and other losses of the User for reasons related to the User's lack of computer equipment with the necessary set of software and technical capabilities that allow the full use of the Service.

5.4. JSC FPС shall not be responsible for the delivery, quality and composition of the food (food and beverages) ordered by the User.

5.5. JSC FPС shall not be responsible in case of complete or partial inoperability of the Service or its components, including absence of access to the Service for the User or occurrence of any indirect or direct costs for the User in connection with these circumstances.

5.6. JSC FPС shall not be responsible for the work of the credit organization (bank, non-bank credit organization), from which account the User transfers funds to pay for the Order.

5.7. Depending on the region and other circumstances, all or some Service functions may not be available or limited, including the possibility of the Order payment in a non-cash way via the Internet, and other technical or technological functions of the Service.

5.8. JSC FPС shall not be responsible for the content and/or relevance of the information provided by the Supplier about food (food and beverages), including information on their availability, value, timing of preparation and Delivery.

5.9. JSC FPС shall not be responsible for failures and interruptions in the Service and/or availability of functionality and the resulting loss of information.

5.10. JSC FPС shall not be responsible for the damage caused to the User as a result of improper use, storage, consumption of products contained in the Order, for the damage of food (food and drinks) delivered in the Order, including in case of untimely use by the User (after one hour from the moment of delivery). The Supplier may set a different shelf life of the Order products.

Consent of the personal data subject to the processing of his/her personal data

I, the User, for the purpose of placing an order through the "Restaurant Food Delivery" Service, located on the Internet at: https://eng.rzd.ru, give my consent to Joint Stock Company Federal Passenger Company, located at: 107078, Moscow, 34, Masha Poryvaeva St. for the processing of my personal data posted by me personally in the forms located in the Service.

The purposes of personal data processing shall be: on terms and conditions of the offer, provide the User with the possibility of using the Service; review the range of food (foods and beverages) of the Suppliers; place an order (including order payment for the purchase of food (food and beverages)), its Delivery to the wagon of a long-distance train.

Methods of processing personal data shall include: collection, recording, systematization, accumulation, storage, clarification (update, modification), use, transfer (provision, access), depersonalization , blocking, deletion, destruction, as well as any other actions with personal data in accordance with the legislation of the Russian Federation.

This consent to the personal data processing shall be considered to be received by the Company from the moment the User pushes the button ""Place an Order" (which is a confirmation of reviewing the rules and specifics of order placement).

Consent may be revoked by the User at any time by sending to the e-mail address of the Service Operator (JSC FPС) delo@fpc.ru of the letter signed by the User or his/her authorized representative.

On behalf of JSC FPС, the User's personal data shall be processed by the following legal entities:

  • The carrier company performing the User transportation, in case of placing an order by the User;
  • Suppliers of food (food and beverages) with which the Company has concluded a contract for delivery of food (food and beverages) to a long-distance train wagon where the User travels.
