The interaction of DOSS with legal entities
1. General Provisions
This procedure is an integral part of the agreement for the provision of services for the execution of travel documents (railway tickets, hereinafter, the "tickets") and related services, which is entered into with Directorate for High Speed Service, a branch of JSCo "RZD", on the terms and conditions specified in the agreement.
This procedure shall take effect upon signing of the agreement for the provision of services for the execution of travel documents (railway tickets, hereinafter, the "tickets") and related services with Directorate for High Speed Service, a branch of JSCo "RZD", and shall regulate all aspects of a legal entity’s interaction with Directorate for High Speed Service, a branch of JSCo "RZD", regarding the issues related to the subject matter of the agreement.
This procedure shall constitute a public offer.
The current version of this procedure is published on the website of JSCo "RZD".
2. List of Abbreviations
JSC "FPC" shall mean Joint Stock Company "Federal Passenger Company";
ACS "Express" shall mean Express, an automated control system for passenger transportation on the railway transport operated by JSCo "RZD";
Booked Order shall mean the seat reservation technology with the subsequent issuance of travel documents in specialized booking offices within the period fixed by the Carrier from the time of reservation, which is primarily applied to execute OGP (OGC, OGS, OGMP), as well as, at the Carrier’s discretion, for individual passengers should the standard period of reservation be increased;
Return shall mean an operation of full cancellation of seats issued earlier, which is made in ACS "Express" according to the Rules of Transportation;
DHSS shall mean the Contractor (as a party to the agreement), Directorate for High Speed Service, a branch of JSCo "RZD";
UPA shall mean the unified personal account of a legal entity in the management and reporting systems of JSCo "RZD";
Application for Transportation shall mean a formal written request from a legal entity to the Carrier for allocation of seats in a train to arrange the travel of OGP (OGC, OGS, OGMP);
JSCo "RZD" shall mean Joint Stock Company "Russian Railways";
OGMP shall mean the organized group of military personnel comprised of at least 10 persons travelling in one train, with the same date of departure, the same route and accompanied by the team chief, which is executed on presentation of a military carriage document at a booking office and issued on one order;
OGC shall mean the organized group of children comprised of at least 10 persons aged under 10 years, including the date of birth if it coincides with the date of train departure, travelling in one train, with the same date of departure, the same route and accompanied by an adult, on the basis of no more than 1 accompanying adult per 10 children, issued on one order;
OGP shall mean the organized group of passengers comprised of at least 10 persons travelling in one train, with the same date of departure and the same route, which is issued on one order;
OGS shall mean the organized group of schoolchildren comprised of at least 10 persons aged from 10 to 18 years, including the date of birth if it coincides with the date of train departure, travelling in one train, with the same date of departure, the same route and accompanied by an adult, on the basis of no more than 1 accompanying adult per 10 schoolchildren, which is issued on one order;
Transportation Organizer shall mean the Customer (as a party to the agreement), a legal entity that organizes the transportation of passengers as a part of OGP (OGC, OGS, OGMP), subject to the relevant agreement with DHSS or sale agent;
Reservation Period shall mean the time frame fixed by the Carrier in ACS "Express" during which seats may be sold;
Rules of Transportation shall mean the Rules of Rail Transportation of Passengers, Luggage and Freight Baggage approved by Order No. 473 dated December 19, 2013 of the Ministry of Transport of the Russian Federation.
Seat Reservation shall mean the allocation of seats from the free sale for the purpose of separate storage thereof in ACS "Express" within the fixed reservation term for the subsequent issuance of travel documents;
Group Leader shall mean a person in charge directly accompanying OGP (OGC, OGS, OGMP) and authorized, on behalf of the group, to perform actions delegated thereto according to the power of attorney (М-2 form) granted by the Transportation Organizer.
Free Sale shall mean the norm of seats without the designated purpose, to be sold via ACS "Express" through the publicly-available sales channels;
Reservation Fee shall mean a fee for the service for reservation of seats in long-distance trains, which is set by FAS of Russia;
Service Charge shall mean a charge (including a voluntary one) included in the total cost of travel and related to additional services provided to a passenger directly en route (food, printed and other products according to the standards set by the Carrier for the relevant class of service);
Mixed Group shall mean the organized group of passengers comprised of at least 10 persons (adult passengers as well as children and/or schoolchildren) travelling in one train, with the same date of departure and the same route;
Special Tariff Plan shall mean a tariff set by the Carrier to organize the transportation of the target audience, in respect of which the calculation rules applied are different from those applied to the general tariff;
Reservation Term shall mean a period of availability of a seat for the issuance thereof from the separate storage system within ACS "Express" using the password and/or booked order technology;
Tour Operator Activities shall mean the activities related to the formation, promotion and sale of the tourist product, which are carried out by a legal entity or individual entrepreneur (tour operator) based on a certificate in accordance with Federal Law No. 132-FZ "On Fundamental Principles of Tourist Activities in the Russian Federation" (dated November 24, 1996);
FAS shall mean Federal Antimonopoly Service of the Russian Federation;
Partial Return shall mean an operation of cancellation of a part of seats issued earlier in one travel document, which is made in ACS "Express" according to the Rules of Transportation;
Appearance shall mean the date fixed for the issuance of a travel document using the password and/or booked order technology.
3. Formation and Processing of Application for Arrangement of Transportation
3.1 To arrange the transportation of OGP (OGC, OGS, OGMP), the Transportation Organizer shall submit an application to DHSS as well as the passenger list with the details of identity documents in the form approved by DHSS according to Annexes 1 and 2.
3.2 Applications for transportation of OGP (OGC, OGS, OGMP) shall be accepted during the entire Reservation Period, depending on the depth of sale fixed for a particular train, but not later than 10 days before the train departure. The application submitted less than 10 days before the train departure shall be accepted if it can be performed. When filling in the application, the category of a group – OGP, OGC, OGS, OGMP – must be indicated.
3.3 The applications submitted for trains beyond the Reservation Period shall be accepted for performance on the resolution of the DHSS head or his substitute.
3.4 The Reservation Fee shall be charged for the reservation of seats from the free sale for the subsequent sale thereof at a special tariff for the arrangement of transportation of OGP (OGC, OGS, OGMP); the Reservation Fee shall not be refunded in case of full or partial refusal to repurchase reserved seats.
3.5 The amount of outstanding invoices may be paid both in cash and non-cash form.
3.6 Partial payment of the required amount shall not be allowed.
3.7 Combination of various payment methods (cash, non-cash) shall not be allowed.
3.8 If the amount specified in the payment order is less than the amount of travel documents to be issued, the travel documents shall not be issued to the Transportation Organizer and the remaining amount of the cost of travel may not be paid in cash.
3.9 The Reservation Fee shall not be broken down into days. If the application is repurchased earlier than 10 days paid by the Transportation Organizer for extension of the application, the funds for unused days shall not be refunded.
3.10 In case of non-appearance of the Transportation Organizer’s representative within the established deadline to execute the travel of OGP (OGC, OGS, OGMP) on blank travel documents, the application shall be cancelled and the Reservation Fee shall not be refunded.
3.11 To pay for the services for the execution of travel documents (railway tickets, hereinafter, the "tickets") and related services in non-cash form, the Transportation Organizer must have the UPA.
3.12 Collection of the required amount from the payment order executed other than in compliance with the VAT rate stated in the invoice shall not be allowed.
3.13 Different services shall be paid by separate payment orders specifying the number and date of the agreement, type of service and the VAT rate in the "Payment details" field of the payment order:
- Services subject to VAT at the rate of 18% – the VAT amount is indicated;
- Services subject to VAT at the rate of 10% – the VAT amount is indicated;
- Services subject to VAT at the rate of 0% – "VAT 0%" is indicated;
- Exempt services (including services not subject to VAT) – "w/o VAT" is indicated;
- Fines and penalties – "w/o VAT" is indicated.
If the advance payment is made for the Services of a third-party carrier (other than JSCo "RZD"), this fact shall be specified in the payment details.
3.14 The tariff cost may be paid separately from the Reservation Fee.
3.15 The funds paid by the Transportation Organizer in excess shall be recognized by DHSS in the future periods on account of the same types of Services taking into account the tax rates at which the advance payment was received.
3.16 The funds credited to the Transportation Organizer’s sub-accounts may be transferred from one sub-account to another sub-account only in exceptional cases subject to agreement with DHSS.
3.17 Upon payment of the Reservation Fee, the Transportation Organizer shall present the respective payment order to the booking office of DHSS to confirm the payment.
3.18 The period for repurchase of seats for OGP (OGC, OGS, OGMP) may be extended for the next period on written or oral request of the Transportation Organizer subject to the repeated payment of the Reservation Fee.
3.19 The date of receipt of the funds shall be the date the funds are credited to the settlement account of JSCo "RZD", as confirmed by a bank statement. The Transportation Organizer shall make payments in Russian Rubles.
3.20 Seats for the arrangement of collective transportation (OGP, OGC, OGS, OGMP) shall be reserved based on the approved application only after the Reservation Fee has been paid. In case payment is made in non-cash form, seats shall be reserved only upon confirmation that the funds were credited to the settlement account stated in the agreement.
3.21 The fact that the funds were credited to the settlement account of JSCo "RZD" shall be confirmed within 3 calendar days on presentation of the respective payment order to the booking office of DHSS.
3.22 The period of storage of the reserved seats for the organization of travel of OGP (OGC, OGS, OGMP) shall be 10 days after the reservation date, but not later than 10 days before the train departure. If seats are reserved less than 10 days before the train departure, the reserved seats shall be repurchased the next day.
3.23 The appearance time shall be set by ACS "Express" automatically based on the date and time of the train departure. According to the standard procedure, the transfer of unsold seats stored in the booked order to the free sale shall be made at 8:00 p.m. (Moscow time).
3.24 In case of any changes in the travel parameters reflected in the examined application, the Transportation Organizer shall, not later than one day prior to the appearance date, inform the responsible employee of DHSS thereof in writing.
3.25 In case the number of OGP (OGC, OGS, OGMP) becomes less than ten (10) persons, the application shall be cancelled; the application of the group tariff and the rules of execution of OGP shall not be allowed; the cost of travel documents may change.
3.26 Legal entities which submit applications for the transportation of OGP, OGC, OGS or OGMP in trains going outside the territory of the Russian Federation or en route through the territory of other states shall comply with passport and administrative (visa), customs, sanitary and other rules. DHSS shall not be liable for the consequences of non-compliance with these rules by passengers.
3.27 At the end of a month, the work with applications shall be analyzed taking into account the repurchased seats and the received cancellations of reserved seats to make a decision on the organization of further work with specific Transportation Organizers.
4. Organization of Sale of Seats for a Group of Children and/or Schoolchildren
4.1 As regards planned transportations of OGC (OGS), applications may be accepted also for trains out of the current Reservation Period. In this case, the list of OGC (OGS) shall be submitted to the booking office at the time of execution of travel documents.
4.2 DHSS shall develop the relevant plans based on the received applications for the transportation of OGC (OGS).
4.3 No seats may be reserved for OGC (OGS) in rail cars in which seats for OGMP are reserved or issued.
4.4 Seats for the travel of OGC (OGS) in rail cars shall be allocated compactly.
4.5 If the number of OGC (OGS) exceeds the number of seats in a rail car, the execution and distribution of the accompanying adults shall be made in proportion to the number of children in a rail car. If the Transportation Organizer so wishes, vacant seats in a rail car with OGC (OGS) may be issued at full fare.
4.6 Issuance of travel documents and organization of transportation of children shall be made according to Regulation No. 31 of the Chief State Medical Officer of the Russian Federation (dd. April 4, 2003) "On Implementation of Sanitary Rules "Sanitary and Epidemiological Requirements to Rail Transportation of Organized Groups of Children. SP 2.5.1277-03".
5. Application Consideration Procedure
5.1 Only duly executed applications shall be accepted for consideration.
5.2 In case it is not possible to satisfy the submitted application, an authorized employee of DHSS shall propose other options for the organization of transportation by changing the parameters of departure (number of a train, service class, etc.). If it is not possible to carry out a collective transportation or the options offered by the authorized employee are rejected, DHSS reserves the right to reject the application.
5.3 Submitted applications shall be considered within 1 business day.
5.4 The approved application shall constitute a ground for issuing an invoice to pay for the services involving the execution of travel documents (railway tickets, hereinafter, the "tickets") and related services according to the current tariffs, tax rates and rules approved under the applicable laws of the Russian Federation.
5.5 In case the cost of the Services is changed, DHSS shall issue an additional invoice for the deficient amount.
6. Requirements to the Procedure for Issuance of Reserved Seats
6.1 The execution of travel of OGP (OGC, OGS, OGMP) based on an application shall be made in the name of the Group Leader on one or several blanc travel documents, separately for each rail car.
6.2 The issuance of travel documents for the companies which do not have a license for Tour Operator Activities, as well as based on individual applications shall be made separately for each passenger.
6.3 Upon receipt of travel documents (tickets), the Transportation Organizer shall be held solely liable for the safety and authenticity thereof (loss, damage, theft, correctness of execution, including the correctness of entered personal data of OGP participants, etc.).
7. Replacement of Organized Group Leader
7.1 This procedure for replacing the Group Leader shall apply only to travel of OGP (OGC, OGS, OGMP) within the territory of the Russian Federation in trains and rail cars operated by JSCo "RZD".
7.2 The Leader of OGP (OGC, OGS, OGMP) shall be replaced on written request of the Transportation Organizer. Upon consideration of the request, an authorized manager of DHSS shall return the travel document issued in the name of the Group Leader and issue a new travel document in the name of a reappointed Group Leader. This being the case, DHSS shall exclude the return of a seat issued earlier to the free sale.
7.3 Along with submitting an application for the replacement of the Leader of OGP (OGC, OGS, OGMP), the Transportation Organizer shall provide DHSS with new passenger lists in order to make the required changes in ACS "Express". Both copies of the new passenger list shall be certified by the stamp of the booking office.
7.4 When boarding a train, the Group Leader shall produce the travel document, group travel documents issued in the name of the previous Group Leader and the amended passenger list.
8. Boarding Procedure
8.1 To board a train, passengers shall produce to the conductor the original copies of all travel documents (tickets) and identity documents specified in travel documents.
8.2 The Transportation Organizer agrees that authorized employees of DHSS may, when boarding a train, randomly check the conformity of a passenger’s personal data specified in passenger lists to the produced identity documents of a passenger.
9. Procedure for Returning Unused Travel Documents
9.1 Unused travel documents issued for the organization of group transportation shall be returned according to the Rules of Transportation.
